Privacy Statement for Dilworth Response

Dilworth Response may collect your personal information in the course of its work. This information is managed with sensitivity and in accordance with NZ privacy legislation.

Dilworth Response respects your personal information, ensuring that it is used and shared only in ways that support our efforts on behalf of the Dilworth Trust Board to address the issue of historical sexual and other abuse that occurred at Dilworth School.

What personal information can Dilworth Response collect?

We will take steps to ensure that we collect only personal information that is necessary to provide the support that is available to all former students who were abused at Dilworth School.  This may include:

  • Your name, date of birth, address and contact number;
  • Information from your Dilworth School file;
  • Information about your current circumstances so we can assess how best to provide you with support; and
  • Information about other people who were involved in or otherwise aware of the historical abuse.

We may use your personal information to provide you with support through the following pathways:

  • Facilitating referral to the confidential Listening Service, for former Dilworth students who want to access fully funded independent professional psychological therapy or support; and/or
  • Facilitating access to the Dilworth Redress Programme; and/or
  • Alternative support pathways, for former students, their families/whānau and families of deceased former students who are not eligible for redress under the Terms of the Dilworth Redress Programme.

In addition, and only when you provide your consent to do so, we may collect your personal information necessary when seeking views and insights from former students, family and staff from Dilworth’s wider community for Dilworth’s stakeholder feedback initiatives.

From whom can Dilworth Response collect personal information?

Wherever possible, we will collect personal information about you directly from you. However, in some cases, it will not be possible for us to collect personal information directly from you or the individuals concerned. We may collect personal information from the following third parties:

  • Dilworth School – On receiving a request for support from a former student or Redress Facilitator, we will collect a copy of the former student’s Dilworth School file. We may also need to collect personal information about people other than the former student from Dilworth School.
  • Anyone else you consent to us contacting – you can give consent for relevant organisation(s) to provide to us information they hold about you, to minimise stress and trauma.

How can Dilworth Response use your personal information?

We will use your personal information only for the purposes of considering your request for support, or participation in a programme managed or supported by Dilworth Response. This may include using your information in the following ways:

  • Assisting a former student, former family member of former staff member with any support services they request from Dilworth Response, including counselling, or other support;
  • Managing the safety and wellbeing of all individuals who request support services from Dilworth Response; and
  • Managing the efficient administration of research requiring interviews or other forms of feedback gathering.

Can Dilworth Response disclose your personal information to third parties?

Yes, sometimes. Examples include:

  • We will disclose your personal information to our confidential Dilworth Listening Service if you consent to this.
  • We will need to disclose your name and age to Dilworth School in order to facilitate a request for information related to the request for support.
  • We may disclose your personal information to the Police where we believe this is necessary in order to assist the Police with the investigation or prosecution of historical abuse offences.
  • We may disclose your personal information to emergency services where we believe this is necessary in order to lessen a serious threat to the life, health, or safety of any individual.

Will Dilworth Response ensure your personal information is protected?

Yes. We will take all reasonable steps to protect your personal information from loss, unauthorised access, use or disclosure, or any other misuse and will retain your personal information only for as long as we have a lawful purpose to use it.

Can you have access to the personal information Dilworth Response holds about you?

Yes. You have the right to ask Dilworth Response whether it holds personal information about you, and to request a copy of that information if we do. You also have a right to request that Dilworth Response makes a correction to personal information that it holds about you. A third party may not ask for your personal information without your prior consent or unless disclosure is allowed or required under the Privacy Act 2020.
